DFCS-related Adoptions FAQ
When is my hearing date? Foster parents have frequently filled out a lot of paperwork with DFCS before they even choose an attorney, but there is more to do before a hearing is scheduled. An adoption attorney will file the appropriate paperwork with the court system, find out which judge is assigned to the case, and then can request a hearing be placed on the court’s calendar.
Can I let the biological parent(s) visit the child(ren) after the adoption? There are lots of things to consider regarding post-adoption contact. Some biological parents have bond conditions or other orders which legally prevent them from visiting with the child(ren), regardless of the adoption status. Allowing biological parents with a history of abuse or neglect to have access to the child(ren) could result in a DFCS investigation which could negatively impact your parental rights.
How long does the process take? There are a lot of documents that must be completed by DFCS. DFCS must provide the adoption attorney with hard copies (originals) of those documents, typically via mail. Only then can an adoption attorney finalize a petition for your signature and filing. Once the petition is filed with the court, your attorney may be able to request an expedited hearing; however, the scheduling will depend on the availability of the judge and the court calendar.
