How Dyal Jenkins Can Help Streamline the Adoption Process

Adoption is a life-changing journey that brings immense joy, but it can also be complex, time-consuming, and emotionally challenging. At Dyal Jenkins Whetsel, we understand the intricacies of adoption law and are dedicated to helping families navigate the process with confidence and clarity. Whether you are adopting privately or through foster care, having an experienced legal team by your side can make all the difference.

Understanding the Adoption Process

The adoption process involves multiple legal steps, including home studies, filing petitions, attending court hearings, and completing post-adoption requirements. Each step comes with its own set of rules and regulations, which can vary depending on whether the adoption is private or through foster care. Without proper guidance, families may encounter delays, paperwork errors, or legal obstacles that can extend the process unnecessarily.

At Dyal Jenkins Whetsel, we specialize in helping families understand and comply with all legal requirements. From explaining the timeline and necessary documentation to ensuring compliance with state and federal laws, we provide clear guidance every step of the way.

Reducing Stress and Delays

One of the biggest challenges in adoption is managing the administrative and legal requirements efficiently. Missing deadlines, incomplete forms, or procedural errors can result in delays or even jeopardize the adoption. Our experienced adoption attorneys streamline the process by:

  • Organizing paperwork: We make sure all forms are complete, accurate, and filed on time.
  • Coordinating with agencies: We liaise with adoption agencies, social workers, and government offices to prevent miscommunication or delays.
  • Guiding home studies: We prepare families for home visits and evaluations, ensuring they meet all legal and procedural standards.
  • Representing families in court: Our team advocates for clients during hearings to protect their rights and move the adoption forward smoothly.
  • Navigating termination of parental rights: While many biological parents are in agreement with adoptions, our attorneys are experienced in handling the complex and contested matters.

By handling these critical tasks, we minimize stress and help families focus on what really matters: preparing to welcome a child into their home.

Tailored Support for Every Family

Every adoption is unique, and every family has distinct needs. Whether you are adopting a newborn, a sibling group, or an older child, we tailor our services to your situation. We also provide guidance on:

  • Foster-to-adopt cases: Ensuring proper legal steps are taken when transitioning children from foster care into permanent homes.
  • Step-parent or relative adoption: Handling cases where a family member seeks legal custody of a child.
  • Fictive Kin or other adoption: For adoptive parents who have already been raising children in their home with an established, loving connection, regardless of biological or legal relation

Our personalized approach ensures that your adoption journey is as efficient, clear, and positive as possible.

DFCS-related Adoptions FAQ

When is my hearing date? Foster parents have frequently filled out a lot of paperwork with DFCS before they even choose an attorney, but there is more to do before a hearing is scheduled. An adoption attorney will file the appropriate paperwork with the court system, find out which judge is assigned to the case, and then can request a hearing be placed on the court’s calendar.

Can I let the biological parent(s) visit the child(ren) after the adoption? There are lots of things to consider regarding post-adoption contact. Some biological parents have bond conditions or other orders which legally prevent them from visiting with the child(ren), regardless of the adoption status. Allowing biological parents with a history of abuse or neglect to have access to the child(ren) could result in a DFCS investigation which could negatively impact your parental rights.

How long does the process take? There are a lot of documents that must be completed by DFCS. DFCS must provide the adoption attorney with hard copies (originals) of those documents, typically via mail. Only then can an adoption attorney finalize a petition for your signature and filing. Once the petition is filed with the court, your attorney may be able to request an expedited hearing; however, the scheduling will depend on the availability of the judge and the court calendar. The attorneys at Dyal Jenkins Whetsel know that families frequently have already been waiting a long time to get to their adoption day before you even meet us. We strive to move your case forward as quickly as possible, and we will keep you updated at every step.

What is my responsibility? You will have to fill out all the documentation requested by DFCS. You will also have to coordinate with an adoption attorney to sign the petition in front of a notary. Your adoption attorney can file the necessary paperwork to finalize the adoption. Once the adoption is complete, the attorneys at Dyal Jenkins Whetsel also assist with updating the child(ren)’s birth certificate(s). You can then use the updated birth certificate to update the child’s social security card and other important records.

Will I receive ongoing adoption assistance? Ongoing adoption assistance eligibility is determined by DFCS on a case-by-case basis. Contact DHS or visit their website for more information.
